Terms of Use

The short version. Mimiroid is free. Your photos stay yours. Share a calendar only with someone you trust, because they can edit and delete anything in it. Do not put anything illegal in it. There is no warranty, and no promise the service will run forever โ though you will get notice if it is shutting down.
1. The agreement
These terms are between you and Haotian An, an individual developer ("we", "us"). By using Mimiroid you accept them. If you do not, do not use the app.
You must be at least 13 years old to have an account.
2. Your licence to use the app
You get a personal, non-transferable licence to use Mimiroid on Apple devices you own or control, as permitted by the App Store's Usage Rules. The app is licensed, not sold. You may not copy, redistribute, rent, reverse-engineer or modify it, except where law expressly permits it regardless of what this says.
3. Your account
You need an account, and you are responsible for what happens under it. Keep your password to yourself. If you sign in with Google, keeping that account secure is on you as well. Tell us at mimiroidofficial@gmail.com if you think someone else is using your account.
One account, one person. Do not share an account โ share a calendar, which is what the app is for.
4. Your content stays yours
You own your photographs and everything you write. Nothing here transfers ownership of them.
You grant us only the permission needed to run the app: to store your content, and to show it to the one other person in your calendar. That permission exists so the app can function and ends when you delete the content or your account. We do not use your photos to promote the app, do not show them to anyone else, and do not use them to train anything.
5. Sharing a calendar โ read this part
A calendar holds two people. When you invite someone and they accept, either of you can add, edit or delete any sticker in that calendar, including ones the other person made. That is deliberate: it is a shared calendar, not two private ones side by side.
So share only with someone you trust. If you leave a shared calendar, the stickers you added stay in it โ they belong to the calendar, and the other person keeps them.
Invite links and codes are single-use and expire. Do not post one publicly; anyone holding it before it expires can join your calendar and see everything in it.
6. What you must not do
- Upload anything unlawful, or anything you do not have the right to upload.
- Upload sexual content involving minors, or content that harasses, threatens or defames someone. Photographs of other people should be ones they are content for you to share.
- Attempt to reach another person's data, break the app's security rules, or interfere with the service.
- Use the service to send unsolicited messages, or to store data on someone else's behalf as a business.
- Automate abuse โ scripted account creation, brute-forcing invite codes, or anything that degrades the service for others.
An account may be suspended or removed for a serious or repeated breach. Where it is reasonable to do so, you will be told why and given a chance to get your data out first.
7. The service may change, and may end
Features may be added, changed or removed. If Mimiroid is ever shut down, you will be given at least 30 days' notice by email and a way to export your photographs before it goes. That is a commitment, not a courtesy โ the content is irreplaceable and the whole app is about photographs of people's lives.
The app is free today. If a paid feature is ever introduced, what you already have will not be taken away and put behind it.
8. Keep your own copies
The photographs you add are backed up, but the app is not a backup service and should not be the only place a photograph exists. Keep your originals in your photo library or wherever you normally keep them.
9. No warranty
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that data will never be lost.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this may not apply to you.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid for it in the previous twelve months (which, while the app is free, is nothing) or US $50.
Nothing here limits liability that cannot lawfully be limited.
11. Apple
Required terms, because the app is distributed through the App Store:
- This agreement is between you and us, not with Apple. Apple is not responsible for the app or its contents.
- Apple has no obligation to provide support or maintenance for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Beyond that, Apple has no warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection or privacy law.
- If a third party claims the app infringes their intellectual property, we โ not Apple โ are responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Governing law
These terms are governed by the federal laws of the United States and by the laws of the state in which the developer resides, without regard to conflict-of-laws rules. Nothing here deprives you of the protections of the consumer-protection law of the state where you live.
13. Changes to these terms
If these terms change, the date at the top changes. A material change will be announced in the app before it takes effect. Continuing to use the app after that means you accept the new terms; if you do not, delete your account, which you can do from Settings at any time.
